Terms of Service

1. Agreement to Terms

By accessing and using Smart Asset Management (SAM), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our website located at getsam.app (the "Service") operated by Smart Asset Management ("us", "we", or "our").

2. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times.

  • Account Security: You are responsible for safeguarding the password and all activities under your account
  • Unauthorised Access: You must notify us immediately of any unauthorised use of your account
  • Account Limits: One person or legal entity may not maintain more than one free account
  • Automated Accounts: Accounts registered by "bots" or other automated methods are not permitted
  • Termination Rights: We reserve the right to refuse service or terminate accounts at our sole discretion

3. Acceptable Use

You agree not to use the Service:

  • For any unlawful purpose or to solicit others to unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code
  • To spam, phish, pharm, pretext, spider, crawl, or scrape
  • To interfere with or circumvent the security features of the Service

4. Subscription & Billing

Some parts of the Service are billed on a subscription basis ("Subscription(s)").

  • Billing Cycle: Subscriptions are billed in advance on a recurring monthly or annual basis, depending on your plan
  • Free Trial: We may offer a 14-day free trial. No payment is required during the trial period. At the end of the trial, you will need to subscribe to a paid plan to continue using premium features
  • Auto-Renewal: At the end of each billing cycle, your Subscription will automatically renew unless you cancel before the renewal date
  • Cancellation: You may cancel your Subscription renewal at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period
  • Payment: A valid payment method is required to process the payment for your Subscription. You shall provide accurate and complete billing information
  • Refunds: Refunds are handled in accordance with our Refund Policy and applicable UK consumer protection law. See our Refund Policy at getsam.app/refund for full details
  • Price Changes: We may adjust pricing with at least 30 days advance notice prior to any changes taking effect. Existing subscribers will be notified by email before any price increase applies to their subscription

5. Cancellation Rights & 14-Day Cooling-Off Period

Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a statutory 14-day cooling-off period when purchasing digital content or services online.

  • Cooling-Off Period: You have 14 days from the date of your first payment to cancel and receive a full refund. This is separate from any free trial period
  • Consent to Immediate Access: At checkout, you may be asked to consent to immediate access to the digital content. By giving this consent, you acknowledge that you will lose your 14-day cancellation right once you access or use the digital content
  • How to Cancel: To exercise your cancellation right, notify us by email at billing@getsam.app or through your account settings before the 14-day period expires
  • Refund Processing: If you are entitled to a refund, it will be processed to your original payment method within 14 days of us receiving your cancellation notice

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Smart Asset Management and its licensors.

  • Protection: The Service is protected by copyright, trademark, and other laws
  • Trademarks: Our trademarks and trade dress may not be used without prior written consent
  • Your Content: You retain ownership of content you upload, but grant us a licence to use it for providing the Service
  • Restrictions: You may not reverse engineer, decompile, or disassemble the Service
  • Feedback: Any feedback or suggestions you provide may be used by us without compensation

7. Limitation of Liability

In no event shall Smart Asset Management, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Your sole remedy for dissatisfaction with the Service is to stop using the Service. The maximum aggregate liability of Smart Asset Management for all claims related to the Service shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

8. Termination

We may terminate or suspend your account in the following circumstances: breach of these Terms, fraudulent or illegal activity, non-payment, or conduct that harms other users or the integrity of the Service. Where possible, we will provide reasonable notice before suspension or termination.

  • Upon termination, your right to use the Service will cease immediately
  • You may terminate your account at any time through account settings
  • Termination will not relieve you of any obligations incurred prior to termination
  • We may retain certain information as required by law or for legitimate business purposes
  • You may request your data within 30 days of termination

9. Governing Law

These Terms shall be interpreted and governed by the laws of the United Kingdom, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
